Suspected murderer to be in court Tuesday
OLMITO - A man convicted in the beheading of his three children is back in the Valley this evening.
John Allen Rubio is being held at the Carrizales Detention Center in Olmito and is scheduled to be in court Tuesday.
Rubio was convicted of beheading his three children back in 2003 and was sentenced to death row. Last month, the Criminal Court of Appeals in Austin decided a written statement by his common-law wife should never have been allowed into testimony, and they overturned his murder convictions.
Rubio's new court-appointed attorney Larry Warner tells NEWSCHANNEL 5 a gag order has been put on the case, but he is certain that Tuesday everything will be put in place.
