Appeals court overturned murder conviction

BROWNSVILLE - Preparations are being made for the retrial of John Allen Rubio. He was convicted of murdering his three children in 2003. But the appeals court overturned the conviction in September.

Rubio appeared at the Cameron County Courthouse today.

Judge Art Nelson issued a bench warrant ordering Rubio to be present for all the hearings. He also ordered Nat Perez to be lead counsel and Ed Stapelton to be co-counsel in the case.

Larry Warner will be Rubio's attorney only on appeal.
