Court: Common-law wife's testimony shouldn't have been used

BROWNSVILLE - A man convicted of the murder and beheading of three children will be returning to the Valley.

The Texas Court of Criminal Appeals overturned the conviction of John Allen Rubio. He'll now be taken off death row in Livingston and return to Cameron County.

He'll have to be retried for his alleged involvement in the 2003 murders. Rubio and his common-law wife, Angela Camacho, were convicted of the crimes.

But the appeals court ruled Camacho's written and videotaped testimony shouldn't have been allowed into evidence against Rubio, since lawyers weren't allowed to challenge the statements.
