Green Mountain Energy Company Response to Harlingen Customer, Mr. Trevino – Sept. 8, 2009 Please attribute the following response to Green Mountain Energy Company. “Green Mountain Energy Company fully complies with the Texas Public Utility Commission’s rules when signing up retail electricity customers to switch to Green Mountain Energy® electricity service. “First, a customer signs a letter of authorization (LOA) when they enroll with one of our sales agents. The customer provides us with information about their identity such as their address, social security number and date of birth. Second, the customer confirms their wish to switch providers through a third party verification process over the telephone. This call is recorded. After enrolling the customer for service, a customer is sent a welcome kit within approximately 10 days of enrollment. Around the same time this customer would have received a switch notice from ERCOT confirming that they have switched their electricity service and if the customer wished to stop the switch from happening, they had the opportunity to do so via the ERCOT cancellation process. “Green Mountain followed these steps in signing up Mr. Trevino. We have both a signature and recording on file for this enrollment. Additionally, we sent Mr. Trevino a welcome kit and his first two bills. Unfortunately, it wasn’t until the day Mr. Trevino’s electricity was going to be disconnected that we heard from him for the first time. He had over two months to cancel or inquire about his service prior to that time, but he never called within those first 2 months. We would have been happy to work with him and switch him back to his provider. We send out the welcome kit for this very reason. “However, if Mr. Trevino did not intend to sign up for Green Mountain, or if he feels that his intentions were misunderstood, we will waive his charges that he currently owes Green Mountain. We are a company committed to our customers and doing the right thing. If someone doesn’t feel like they gave their knowing approval to be a Green Mountain customer then we will remedy that situation.
