EDINBURG - The state trooper who shot at a truck full of illegal immigrants is back on duty.

Texas Department of Public Safety officials released a statement Thursday afternoon.

"DPS Tactical Flight Officer Miguel Avila, who discharged his weapon, was originally placed on leave with pay, and has since returned to duty," the statement said.

The trooper will be assigned to administrative duties pending the results of the investigation.

Avila shot at the truck from a helicopter during a chase north of La Joya on Oct. 25. Two immigrants from Guatemala died.

DPS officials said the troopers believed the truck was loaded with drugs.
