EDINBURG - No criminal charges will be filed against the deputy U.S. Marshal who shot a kidnapping suspect.
According to an assistant district attorney, a grand jury decided not to move forward with criminal charges against Edgar Hernandez.
The shooting happened in April. Hernandez shot Eliseo Alvarado in the back inside a home in Little Mexico.
Alvarado had been accused of kidnapping his girlfriend and two young children. He's been charged in the case.
Hidalgo County sheriff's investigators learned Alvarado did not have a weapon at the time of the shooting.
Hidalgo County Sheriff Lupe Trevino said Hernandez stopped cooperating with the investigation, so he sent the case to the district attorney's office. Prosecutors then presented the case to a grand jury, who then made their decision.
CHANNEL 5 NEWS contacted Alvarado's attorney in the case. The legal team hasn't decided whether to comment regarding this latest development.
