WESLACO – A federal appeals court decided to block the Deferred Action for Childhood Arrivals from immediately ending.

"Arbitrary and capricious" is how the 9th Circuit Court of Appeals described the government's claim to rescind DACA in their opinion.

DACA allows children who, under no will of their own, entered the country illegally. 

They must have clean criminal records and meet certain educational and military requirements to receive protection from deportation in two-year increments – it began in 2012.

The new administration announced they would rescind these protections in 2017. 

Lawsuits were filed and have been moving through the courts since then. 

Thursday, the U.S. Court of Appeals for the 9th Circuit ruled to keep the injunction that prevents it from ending. 

The injunction is in place; the order to rescind DACA is on halt.

We spoke with immigration attorney Jaime Diez who has clients who are DACA recipients. 

"I think it's good news. I'm sure the government is going to appeal it. And eventually, it may get to the Supreme Court. But, for the time being, I think it's good news for the people here in the Valley, here in Texas, we do have a lot of them," assured Diez. 

For now, Diez urges current DACA recipients to continue renewing their status.

There are about 700,000 recipients who will continue having to wait on what may come on this decision.
