PENITAS – The Hidalgo County district attorney said he’s looking into what happened when surveillance cameras were recording at a poll site and how the video of voters made it out to the public.

Under Texas state law, no one can film within 100 feet of a polling place. CHANNEL 5 NEWS learned the same goes for surveillance video cameras at poll locations.

Last week, surveillance cameras were on at the Penitas Public Library poll site during voting.

The elections office found out and took action to cover up the cameras and protect voters’ privacy.

The district attorney told CHANNEL 5 NEWS he wanted to make sure those cameras were covered as well and to follow up on how the video was released to the public.

“There’s a question about how the video got out. So that’s what we’re in the process of now. We are asking for any kind of documentation that shows whether it was a public information request,” said Hidalgo County District Attorney Ricardo Rodriguez.

The Penitas city manager spoke to CHANNEL 5 NEWS Thursday saying the city was legally obligated to release the video after a records request.

The DA said his inquiry is not an investigation and the matter is not criminal.
