EDINBURG – A case that began nearly 10 years ago is returning to the courts.

A former Hidalgo County constable tried and convicted of using his office to commit theft wants his case heard again.

Eduardo “Walo” Bazan was suspended without pay in April 2008. He was found guilty of using his office as a public servant to steal a Volkswagen.

His defense attorney is requesting a new trial stating new evidence was discovered.

Court documents show that evidence may favor the former constable.

A judge will decide on whether or not to accept the new trial in two weeks.
