LAREDO – A 10-year-old girl with cerebral palsy has been released from federal custody to her family.

The American Civil Liberties Union and Congressman Joaquin Castro said Rosa Maria Hernandez was released Friday evening.

U.S. Border Patrol agents detained her after she underwent an emergency surgery citing she is illegally in the country.

The ACLU sued the government to release the child who had been placed in a San Antonio shelter for unaccompanied minors.

Border Patrol said they had to detain the child because she passed through an interior checkpoint without her parents.
