Jury selection is underway in the capital murder trial of Rogelio Martinez, the man accused in the 2023 shooting death of a San Benito police lieutenant.

The death penalty is on the table in this case. The jury pool includes about 450 people.

The Cameron County Court Clerk told Channel 5 News that potential jurors were not brought back on Wednesday as prosecutors and the defense team review questionnaires filled out by potential jurors.

Channel 5 News spoke with a Brownsville attorney not affiliated with the case about how jury selection works in a death penalty trial.

"It can take a couple of weeks, it can take several months," attorney Aimee Trevino of the Law Office of Aimee A. Trevino said. "It takes a lot longer because you do need to make sure that this person is not someone who is either super against the death penalty or super for it. It needs to be someone who's very level-headed and it's just going to be able to hear all of the evidence."

The jury pool must be narrowed down to 12 jurors and two alternates.

Jury selection began on Tuesday for Martinez's trial. According to previous reports, he was identified as the man who fatally shot San Benito Police Lt. Milton Resendez during a police chase that happened on Oct. 17, 2023.

Rodrigo Axel Espinosa Valdez, the accused driver in the police chase, took a plea deal in connection with the case.
