MCALLEN - A federal judge decided to hold Rodolfo 'Rudy' Delgado's trial in McAllen Monday.

Delgado was indicted by a Houston jury last year on bribery, conspiracy, violation of the travel act and obstruction of justice charges.

The legal defense for Delgado requested the trial be moved back to McAllen believing holding the trial in Houston would mean Delgado would "suffer significant harm."

On Monday, Southern District of Texas Judge Alfred Bennett signed an order approving the case be brought back down to the McAllen Division of the district.

The order cited a newly-adopted rule as reason for moving the case back to the Valley -- Local Criminal Rule 18.

Judge Bennett's order states, "transfer of this case to the McAllen Division for trial purposes only is in the interests of justice."

Judge Bennett, who serves in the Houston Division, will be the judge for the trial in McAllen.
