Fresno, Calif. (KRGV) — The Fresno County District Attorney’s Office charged a 32-year-old ICE agent from McAllen with the assault on a 72-year-old Fresno homeowner and the homeowner’s daughter.

David Gonzalez III pleaded not guilty Wednesday to charges of assault, elder abuse, vandalism, and battery in connection with the incident, Central California ABC affiliate ABC 30 Action News said, adding that investigators said Gonzalez appeared drunk during the incident.

Gonzalez appeared in court in a wheelchair, the ABC 30 Action News said.

According to a release from the district attorney’s office, Gonzalez was found sleeping on the front lawn of a Fresno home during the early morning hours Oct. 9, 2026, when the homeowner asked him to leave.

“Gonzalez assaulted him, causing him to fall to the ground and sustain visible injuries. During the incident, Gonzalez also threw the victim into a neighbor’s parked vehicle, causing significant damage to the side of the car,” the news release said. “When the homeowner’s daughter intervened to help her father, Gonzalez assaulted her as well, causing her to fall to the ground.”

Fearing for his safety and his daughter’s safety, the unidentified homeowner shot Gonzalez. He was later hospitalized.

The DA’s office says Gonzalez faces a maximum sentence of nearly five years if convicted on all charges.

Fresno County jail records show Gonzalez was released on bond Wednesday. ABC 30 Action News said the bond for Gonzalez was set at $37,000, and he’s required to remain in California after posting bond.

The Hidalgo County Sheriff’s Office confirmed to Channel 5 News that Gonzalez worked as a sheriff’s deputy before becoming an ICE agent in December 2025.
