According to a probable cause affidavit obtained by Channel 5 News, Nestor Flores fatally stabbed his brother, 43-year-old Jose Gabriel Flores, in the back during a physical altercation that stemmed from an argument.
Jose Gabriel Flores died from his injuries at the hospital.
Nestor Flores was hospitalized for injuries sustained during the altercation prior to his arrest, the Hidalgo County Sheriff’s Office said in a news release.
A motion to dismiss Nestor Flores’ indictment says the dismissal is “in the interest of justice.”
“After carefully reviewing, we found that there was insufficient evidence to proceed forward on the case,” Palacios said.
