A truck driver cleared of criminal charges in a crash in Alamo is now being held at an immigration detention facility.

A Hidalgo County grand jury declined to indict Jose Fidencio Luna Ramirez on charges linked to a June 19, 2026, crash on the expressway in Alamo where a child was thrown from a vehicle. Several others were also hurt.

Hidalgo County District Attorney Terry Palacios told Channel 5 News a grand jury no-billed his case, meaning the case is now dismissed.

Luna Ramirez had been accused of leaving the scene of the crash. His arrest sparked public outcry after a video went viral on social media showing him at the crash scene.

Police later clarified he had stopped after the crash but left before officers arrived. The adults in the other vehicle were later arrested after police said they caused the crash by colliding with Luna Ramirez's truck.

Hidalgo County jail records show Luna Ramirez was released from the county jail on Wednesday. But his wife, Sindia Robles, says he has not come home.

"Right now he's in an ICE detention center. They placed an ICE hold on him right at the beginning of his detention," Robles said.

Robles says her husband is being held at the Raymondville detention center. She has not been told why he was taken into federal custody.

"He drives legally in this country; he has a visa, a valid I-94 form, a valid international driver's license, and a valid passport, all valid," Robles said.

Robles says she was told her husband would be released in the coming days and returned to Mexico.

For Robles, the grand jury's decision was news she had waited nearly two months to hear. She had spent that time defending her husband publicly.

"I've been fighting for two months against this injustice that was being committed against my husband," Robles said. "I knew it wasn't like that because I've known my husband my whole life. I know he would never do that." 

While charges against Luna Ramirez were dropped, charges remain against two adults who were in the other vehicle. Francisco Davila Jr. and Samantha Vianney Rodriguez are charged with child endangerment.

Police say their investigation found children inside their vehicle were not properly restrained. The Hidalgo County DA's office says those cases have not yet been presented to a grand jury.

On Wednesday, Channel 5 News reached out to ICE to learn more about why the hold was placed on Luna Ramirez. ICE has yet to respond as of Thursday afternoon.
