Texas appeals court denies stay of execution for John Allen Rubio
Weslaco, TX (KRGV) — The Court of Criminal Appeals of Texas denied John Allen Rubio's motion to stop his execution.
On Oct. 28, Rubio's defense team filed a motion that accused prosecutors of using false testimony from forensic psychiatrist Michael Welner.

The filing says Welner told jurors Rubio was not taking antipsychotic medication and did not show signs of psychosis before trial.
In a response, prosecutors argued Rubio had already raised a similar claim that an appeals court dismissed in 2022.

Rubio and his common-law wife, Angela Camacho, were convicted in the 2003 deaths of their three children, ages 3, 1 and 2 months. Investigators say Rubio and Camacho killed the children because they could not support them financially. Camacho is serving life in prison.
Since his arrest in 2003, Rubio has claimed the children were possessed by demons.
Rubio is scheduled to be executed on Nov. 12, 2026.
