Truck driver cleared in Alamo expressway crash is now in ICE custody after release

The 40-year-old truck driver charged in an Alamo crash on the expressway has been cleared of criminal charges after a grand jury declined to indict him, according to Hidalgo County District Attorney Toribio "Terry" Palacios.

Hidalgo County jail records confirm Jose Fidencio Luna Ramirez was released from custody on Wednesday.

Palacios said a grand jury "no-billed" the case, finding not enough evidence to charge Ramirez.

Despite his release, Ramirez’s wife says he is now in ICE custody in Raymondville and is expected to be sent back to Mexico.

Ramirez was identified by the Alamo Police Department as the hit-and-run driver involved in a June 19 crash on the expressway that hospitalized six people, including a 5-year-old child left in critical condition shortly after the crash.

Police said Ramirez collided with a silver Dodge Durango in the crash. The department later clarified that Ramirez stayed at the scene to help, but left before officers arrived.

Francisco Davila Jr. and Samantha Vianney Rodriguez were later arrested. They were identified as the driver and adult female passenger of the Dodge Durango, and the parents of the children in the vehicle.

According to a news release from the Alamo Police Department, an investigation revealed that the Durango was traveling “at a high rate of speed” and that Davila attempted an “unsafe lane change” that led to the collision.

“During the crash, several juvenile passengers were ejected from the vehicle and sustained injuries requiring emergency medical treatment,” police said. “Investigators further determined that multiple occupants were not properly restrained at the time of the collision, including children sharing seat belts and a child safety seat that was not properly secured.”

Davila and Rodriguez remain jailed on bonds of $200,000 each as of Wednesday. Palacios said their cases remain pending.
