EDINBURG – A Rio Grande Valley woman says her husband was killed by an accused intoxicated driver but his death certificate tells a different story.

Celia Gazca tells us it reads as though her husband, Jessie Gazca, was at fault for the accident instead of the suspect currently awaiting intoxicated manslaughter charges.

She explains her husband was riding his motorcycle when a driver traveling over 100 mph hit him from behind.

KRGV’s Trason Bragg reached out to the Hidalgo County Justice of the Peace who signed the certificate, Gilbert Saenz.

"The investigation was not complete at the time when we did the death certificate. Can we do it now? I don't have a problem putting, amending this and kind of detail the accident as it happened,” says Saenz.

He says Gazca was over the legal limit at the time and cannot omit that fact from the report without facing fraud charges from the state.

Saenz says he plans to write a better description on the certificate.
