EDINBURG – A motion was filed Thursday for a change of venue in the case of a Hidalgo County judge facing federal charges.

Judge Rodolfo "Rudy" Delgado is charged with bribery concerning programs receiving federal funds.

Court documents state all the acts alleged were committed in the McAllen division.

The case was filed in the Houston division of the Southern District of Texas.  

The defense argues the government intentionally filed the criminal complaint in Houston in an attempt to gain a “tactical advantage” over Delgado’s rights to defend himself.
