BROWNSVILLE – A Cameron County man is now in custody in connection with a case out of Kansas. 

Jeffrey Henry, co-owner of a Schlitterbahn Waterpark, was arraigned on Thursday. He was arrested Monday by U.S. Marshals out of Brownsville. 

According to the Kansas City indictment, Henry and other park officials knew of the dangers the world's tallest waterslide, Verruckt, posed to the public.  

In August 2016, Caleb Schwab, 10, died from a neck injury while riding the waterslide.

In addition, two women were severely injured. The raft they were riding went airborne and collided with overhead hoops and netting above Verruckt.

We learned whistleblowers employed by the waterpark told authorities that park officials covered up similar events in the past. 

According to the indictment, after the incident, experts in amusement ride safety and design examined the waterslide and found that it violated nearly all of their industry-safety standards published by the American Society of Testing and Materials. 

The indictment also states Henry played a key role in the design and construction of the ride even though he had no technical or engineering credentials. 

In a statement, the waterpark says it’s done nothing wrong and insists what happened to the child was a tragic accident.

The park's former operations director, Tyler Austin Miles, also faces 20 felony charges. They included a single county of involuntary manslaughter over the death of Schwab. 

Henry is being held at the Cameron County Jail without bond.
